Terms of sale<\/strong><\/p>\n

Art. 1 Definitions<\/strong><\/p>\n

1a. These general terms and conditions, made available to the consumer for reproduction and storage pursuant to art. 12 of Legislative Decree 70\/2003, govern the distance purchase of products, by means of a telematic network, through the e-commerce platform www.eredideipapi.com, owned by Eredi dei Papi Srl \u2013 VAT no. 15192911004, in the person of its director, with registered office at Via delle Marmorelle 1711, 00077 Monte Compatri (RM), Italy.<\/p>\n

1b. Online sales contract means the distance contract, i.e. the legal transaction concerning movable goods and\/or services, entered into between a supplier, in this case Eredi dei Papi Srl, and a final consumer, within a distance selling system organised by Eredi dei Papi Srl which, for this contract, exclusively uses the distance communication technology known as the Internet.<\/p>\n

1c. Consumer means the natural person who purchases goods and services for purposes not directly or indirectly related to his or her professional activity.<\/p>\n

1d. Product(s) means the products presented on www.eredideipapi.com and made available by Eredi dei Papi Srl.<\/p>\n

1e. www.eredideipapi.com means the e-commerce platform through which Eredi dei Papi Srl carries out the distance sale of the products offered.<\/p>\n

Art. 2 Scope of application<\/strong><\/p>\n

2a. These general terms and conditions of sale apply to users who fall within the definition of “consumers” under Legislative Decree 206\/2005 and who make purchases through the e-commerce site www.eredideipapi.com, using the purchased product exclusively for private purposes.<\/p>\n

Art. 3 Acceptance of the general terms and conditions of sale<\/strong><\/p>\n

3a. These general terms and conditions of sale are valid from the day of publication on the e-commerce platform www.eredideipapi.com and may be updated, supplemented or amended at any time, taking effect for the future.<\/p>\n

3b. Any change made to these general terms and conditions of sale will be duly notified on www.eredideipapi.com.<\/p>\n

3c. By accessing the e-commerce platform www.eredideipapi.com, the user may conclude the contract for the purchase of the desired product, following the instructions and procedures provided for completing the order and finalising the purchase.<\/p>\n

3d. These general terms and conditions of sale must be carefully examined by the user before completing the purchase procedure. Placing the order and the resulting advance payment imply full knowledge of these terms and their complete acceptance.<\/p>\n

3e. Eredi dei Papi Srl does not consider itself bound by different terms, unless agreed in advance in writing.<\/p>\n

Art. 4 Subject of the contract and of the service<\/strong><\/p>\n

4a. The subject of the contract is the sale of the products published on the platform www.eredideipapi.com<\/p>\n

Art. 5 Conclusion of the contract<\/strong><\/p>\n

5a. These terms of sale constitute an OFFER TO THE PUBLIC.<\/p>\n

Therefore, for the conclusion of the contract, ACCEPTANCE by the user is required, followed by an order confirmation email from Eredi dei Papi Srl.<\/p>\n

5b. Acceptance is expressed by following the on-screen instructions, by correctly completing all sections and by agreeing, selecting the wording “Acceptance of the Terms of Sale and Privacy Law”.<\/p>\n

5c. Receipt of the order does not bind Eredi dei Papi Srl until it has processed the order by written communication or by conclusive conduct, i.e. by shipping the goods.<\/p>\n

5d. Subject to availability, Eredi dei Papi Srl may accept, even only partially, or refuse the order received, notifying the user by email at the address associated with the purchase. In that case the contract will be deemed concluded only for the confirmed goods.<\/p>\n

5e. Eredi dei Papi Srl will keep a copy of the orders received and of the acceptances sent for a reasonable period of time, in compliance with the Applicable Law. This documentation will be stored in the cloud storage space of Eredi dei Papi Srl and will be accessible to staff who need to consult it in relation to their duties, for the proper performance of the contractual terms. The documentation will also be accessible to third parties solely for the purpose of performing the terms, in addition to the parties entitled to access under the Applicable Law, in compliance with privacy protection rules.<\/p>\n

Art. 6 Shipping costs and sale prices<\/strong><\/p>\n

6a. Shipping rates are detailed on the Shipping page.<\/p>\n

6b. Shipping costs depend on weight, volume, delivery destination and\/or any other services requested (insurance, delivery times, change of destination address, etc.). The total amount of shipping costs will be communicated to the user before the order is confirmed.<\/p>\n

6c. Eredi dei Papi Srl is not liable for any damage suffered by the user due to delivery delays.<\/p>\n

6e. All prices shown on the site include VAT.<\/p>\n

6f. Prices may change without notice.<\/p>\n

6g. Eredi dei Papi Srl reserves the right to verify the regularity of advance payments made by credit card, debit card and bank transfer before the final confirmation of the order. In the event of non-payment, Eredi dei Papi Srl may immediately declare all sums due to be liquid and payable in order to obtain payment of the product prices.<\/p>\n

Art. 7 Registration<\/strong><\/p>\n

7a. A user who decides to make a purchase on www.eredideipapi.com through registration must provide, truthfully and completely, all the data requested in the registration form and fully accept the Privacy Policy and these general terms.<\/p>\n

7b. Eredi dei Papi Srl has no visibility of its users’ login credentials, which they are therefore required to keep safe.<\/p>\n

7c. Registered users may deactivate their accounts, request their deletion or stop using the Service at any time, through the site www.eredideipapi.com or by contacting Eredi dei Papi Srl directly by email at info@eredideipapi.com.<\/p>\n

7d. In the event of a breach of these Terms, Eredi dei Papi Srl reserves the right to suspend or close the user’s account at any time and without notice.<\/p>\n

Art. 8 Payment methods<\/strong><\/p>\n

8a. Payment may be made by choosing one of the following methods:<\/p>\n

The payment reference must state the order reference number<\/p>\n

Credit \/ Debit card: through the PayPal portal (secure SSL-protected transaction)<\/p>\n

8b. If the user chooses payment by bank transfer, Eredi dei Papi Srl will wait for the amount to be credited, which must take place within 7 working days of the order confirmation, before proceeding to ship the products. The goods will be held until proof of the transfer (paper or digital payment receipt) is received, which the user must send by email to info@eredideipapi.com, specifying the order reference number, no later than 3 working days from the date of the order confirmation. If the amount is not received within 7 working days of the order confirmation, the order will be automatically cancelled.<\/p>\n

Art. 9 Delivery \/ receipt of the product<\/strong><\/p>\n

9a. From the moment the products are handed over to the courier, deliveries normally take place within 72 hours in mainland Italy and within 5 working days in Sicily, Calabria and Sardinia, unless different timing is specified in the order confirmation and in any case always within the terms set by Legislative Decree 206\/2005 (30 days).<\/p>\n

9b. The order will be delivered to the address indicated by the user when ordering, in the manner provided for by these general contract terms. Eredi dei Papi Srl cannot be held liable for delivery errors due to inaccuracies or omissions in the completion of the purchase order by the user.<\/p>\n

9c. Likewise, no liability may be attributed to Eredi dei Papi Srl for late or failed delivery attributable to force majeure or unforeseeable circumstances or to the carrier’s responsibility.<\/p>\n

9d. Eredi dei Papi Srl is not liable for any damage suffered by the user due to delivery delays.<\/p>\n

9e. Upon receipt, the user is required to check that the product delivered conforms to the order placed. Only after this check, and without prejudice to the right of withdrawal, must the user sign the delivery documents. Acceptance without reservation extinguishes any liability of Eredi dei Papi Srl for any defects.<\/p>\n

9f. Eredi dei Papi Srl recommends carrying out a careful check of the conformity and integrity of the product, taking into account any kind of anomaly it may present, at the time of delivery.<\/p>\n

9g. If, within 24 months of purchase, the product turns out to be damaged, adulterated or altered in its organoleptic composition, Eredi dei Papi Srl invites the user not to consume or ingest the product and to report the damage immediately by email to info@eredideipapi.com, or by contacting the head office directly at +39 351 866 6836.<\/p>\n

9h. In the event of a defect, adulteration or other damage affecting the product, to be reported no later than 10 days from discovery, Eredi dei Papi Srl undertakes to refund the price paid, subject to verification of the product.<\/p>\n

9i. To this end, the user must return the defective product at his or her own expense, without tampering with it, adulterating it or replacing it and without dispersing its contents, to Eredi dei Papi Srl at Via delle Marmorelle 1711, Monte Compatri (RM).<\/p>\n

9l. The product will be subject to the final judgement of Eredi dei Papi Srl. If the checks are positive, Eredi dei Papi Srl undertakes to refund the price of the product (including shipping costs) that is actually found to be defective or, alternatively, to replace it.<\/p>\n

9m. Eredi dei Papi Srl is not liable for damage caused by consuming a product that has been adulterated or damaged in its organoleptic composition, as a result of a failure to check on the part of the user\/customer.<\/p>\n

9n. If the final consumer refuses to receive or is unable to receive delivery of the product, in accordance with these general terms and conditions of sale, all risks connected with the loss of or damage to the products will in any case be borne by the consumer.<\/p>\n

In that case, Eredi dei Papi Srl may:<\/p>\n

demand immediate full payment for the products and make delivery by any means it deems appropriate, or store the products entirely at the customer’s risk and expense;<\/p>\n

in any case demand payment of all storage and holding costs for the products and of any further expense incurred as a result of the refusal or inability to receive delivery;<\/p>\n

cancel the order and dispose of the products, without prejudice to its right to compensation for the damage caused by the user, in addition to the risks and expenses referred to above.<\/p>\n

9o. Where delivery of the products takes place in instalments, each batch of products shall be deemed to relate to a separate and distinct contract; any defect found in one or more batches does not entitle the user to terminate the entire order or contract or to cancel the orders for each subsequent batch.<\/p>\n

Art. 10 Product availability<\/strong><\/p>\n

10a. The user may purchase the products as per the online catalogue published on www.eredideipapi.com.<\/p>\n

10b. Eredi dei Papi Srl, while striving to ensure constant availability, cannot guarantee it, since several users could purchase at the same time and make a product that another user had already placed in the cart unavailable.<\/p>\n

10c. Where payment has already been made, in the event of unavailability, Eredi dei Papi Srl undertakes to promptly inform the user and to refund the price paid, without additional charges, within 30 days.<\/p>\n

10d. Where the customer is nonetheless interested in proceeding with the order, Eredi dei Papi Srl will communicate the procurement and fulfilment times, guaranteeing maximum speed.<\/p>\n

Art. 11 Liability<\/strong><\/p>\n

11a. Eredi dei Papi Srl assumes no liability for disruptions attributable to force majeure such as accidents, strikes and\/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the performance of the contract within the agreed times.<\/p>\n

11b. Eredi dei Papi Srl will not be liable to any party or third party for damage, losses and costs suffered as a result of non-performance of the contract for the reasons mentioned above, the final consumer being entitled only to a refund of the price paid.<\/p>\n

11c. Eredi dei Papi Srl is not liable for any fraudulent or unlawful use by third parties of credit cards, cheques and other means of payment at the time of payment. In fact, at no point in the purchase procedure is Eredi dei Papi Srl able to know the credit card number which, through a secure connection, is transmitted directly to the banking service provider.<\/p>\n

Art. 12 Warranties and assistance<\/strong><\/p>\n

12a. Eredi dei Papi Srl sells products of high quality and offers a warranty whose minimum duration depends on the type of product purchased, in accordance with the Applicable Law.<\/p>\n

12b. All product descriptions, illustrations, depictions, details, dimensions, presentation data and any other information available on the e-commerce platform www.eredideipapi.com are to be understood as general illustrations of the products and do not in any way represent a warranty or declaration of conformity of the products to them.<\/p>\n

Art. 13 User obligations<\/strong><\/p>\n

13a. The consumer undertakes to print these general contract terms in order to fully satisfy the conditions set out in Legislative Decree 206\/2005 (Consumer Code) and to check them periodically by visiting the e-commerce site www.eredideipapi.com. In the event of changes, the consumer undertakes to reprint and keep them, as amended.<\/p>\n

13b. Under the law of 8 November 2012, which implemented Decree-Law no. 158 of 13 September 2012, the sale of alcoholic products to minors is prohibited. Therefore, the user declares that he or she is of legal age and has the legal capacity required to enter into a contract having the force of law between the parties, and that the information provided when placing the order is up to date, accurate and sufficient for the fulfilment of the order. The user also declares that the person receiving the alcoholic product will be of legal age under the legislation applicable to that person.<\/p>\n

13c. The user is strictly prohibited from entering false and\/or invented and\/or fictitious data in the registration procedure required to activate the process for the performance of this contract and the related further communications; personal details and the email address must be exclusively the user’s own real personal data and not those of third parties or fictitious.<\/p>\n

13d. Double registrations corresponding to a single person or entering the data of third parties are expressly prohibited.<\/p>\n

13e. Eredi dei Papi Srl reserves the right to take legal action against any violation and abuse, in the interest and for the protection of consumers.<\/p>\n

13f. The user holds Eredi dei Papi Srl harmless from any liability arising from the issue of incorrect tax documents due to errors in the data provided by the customer, the customer being solely responsible for entering them correctly.<\/p>\n

13g. The user is responsible for his or her own content and that of third parties shared on www.eredideipapi.com, by uploading, entering or in any other way.<\/p>\n

13h. The user holds Eredi dei Papi Srl harmless from any liability in relation to the unlawful dissemination of third-party content or the use of www.eredideipapi.com in ways contrary to the law.<\/p>\n

13i. Eredi dei Papi Srl does not carry out any moderation of the content published by the user or by third parties, but will promptly remove unlawful or offensive contributions if it identifies them directly, following reports from other users or orders issued by public authorities.<\/p>\n

13l. The only rights granted to Eredi dei Papi Srl in relation to content provided by users are those necessary for the operation and maintenance of www.eredideipapi.com.<\/p>\n

Art. 14 Right of withdrawal<\/strong><\/p>\n

14a. Pursuant to art. 64 of Legislative Decree 206\/2005, a consumer who, for any reason, is not satisfied with the purchase made has the right to withdraw from the contract, without any penalty and without giving any reason, within 14 days of receiving the product.<\/p>\n

14b. To exercise the right of withdrawal, the User must inform Eredi dei Papi Srl of the decision to withdraw by an email containing an explicit statement to info@eredideipapi.com. The email must specify:<\/p>\n

The order number<\/p>\n

The day of receipt and therefore of taking possession of the goods<\/p>\n

The products for which the legitimate right of withdrawal is being exercised<\/p>\n

The User’s name, surname and address<\/p>\n

The IBAN of the bank account to which the refund should be made, only if payment was originally made by bank transfer.<\/p>\n

Eredideipapi.com will send a confirmation email to the User, in which the arrangements for the return of the products will be agreed.<\/p>\n

14c. In the case of a purchase of several units, Eredi dei Papi Srl guarantees the consumer the right of withdrawal and return even if a single unit has already been opened and consumed. In this case, as the product is perishable and cannot be stored, the withdrawal will be valid only for the units that remain intact, for which, once returned in the manner indicated in this article, the customer will be refunded the price paid.<\/p>\n

14d. The products must be returned within 10 days of the user’s communication, by means of a Carrier that Eredi dei Papi Srl will send to collect the goods on the agreed day and time.<\/p>\n

14e. The goods must be packed exclusively and strictly in the original packaging, in the same way in which the user originally received the goods from Eredi dei Papi Srl. Should the user send the goods to be returned in packaging other than the original, he or she will implicitly release Eredi dei Papi Srl and the Carrier from any damage the products may suffer during transport, assuming full responsibility for it.<\/p>\n

14f. Eredi dei Papi Srl will accept the returned goods, reserving the right to contest the integrity of the product, and will refund the user the amount initially paid (excluding shipping costs) within 14 days of receiving the return. Until Eredi dei Papi Srl has received the goods, or proof that they have been shipped, it may legitimately withhold the refund.<\/p>\n

14g. The refund will be made using the payment method used by the user at the time of the order. If the user paid by bank transfer, Eredi dei Papi Srl will pay the amount due to the user by bank transfer to the account indicated by the user when communicating the intention to withdraw. In the case of payment via PayPal, the amount relating to the returned goods will be credited back to the customer’s PayPal account net of any PayPal handling fees. The time taken to credit the payment instrument chosen within the PayPal account depends exclusively on PayPal and the banking system. Once the amount has been credited back to the PayPal account, under no circumstances can Eredi dei Papi Srl be held liable for any damage, direct or indirect, caused by delays in the actual crediting attributable to PayPal or the banking system. At no point in the purchase procedure is Eredi dei Papi Srl able to know the information relating to the buyer’s credit card or other methods chosen within the PayPal wallet. Under no circumstances, therefore, can Eredi dei Papi Srl be held liable for any fraudulent and improper use of credit cards by third parties when paying for products purchased on www.eredideipapi.com.<\/p>\n

14g. Under no circumstances will goods returned in packaging and in a manner other than those originally used by Eredi dei Papi Srl be refunded if they reach Eredi dei Papi Srl damaged, even only in part.<\/p>\n

14h. The shipping costs for sending the goods from the user to the premises of Eredi dei Papi Srl at Via delle Marmorelle 1711, Monte Compatri (RM) are borne by the user. Return shipping costs are calculated as follows:<\/p>\n

Up to 6 bottles \u20ac9.90<\/p>\n

From 7 to 12 bottles \u20ac13.50<\/p>\n

From 13 to 18 bottles \u20ac17.90<\/p>\n

14i. Before withdrawing, the consumer has the right to establish the nature, characteristics and functioning of the purchased goods. This means that he or she may do everything that could be done when buying the product in a shop. If the consumer goes beyond this assessment, causing a reduction in the value of the goods, he or she still has the right to withdraw, but must bear the cost of this reduction in value.<\/p>\n

14l. The user is liable only for the reduction in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics and functioning. Therefore, goods that have been used or damaged, even only in part, will not be refunded.<\/p>\n

14m. The supply of goods made to measure or clearly personalised is excluded from the right of withdrawal.<\/p>\n

Art. 15 Communications<\/strong><\/p>\n

15a. Any communication or notice in relation to these terms must be made by registered letter with return receipt or by certified email (PEC) to the addresses indicated in the Contact section.<\/p>\n

15b. The last address or contact communicated by the user will be considered the address to which the communications prescribed by the Applicable Law in relation to legal proceedings must be sent, before the election of domicile at the appointed attorney.<\/p>\n

15c. Every communication is deemed received:<\/p>\n

upon receipt of the registered letter with return receipt;<\/p>\n

at the time and date of confirmation that the certified email (PEC) has been opened by the recipient.<\/p>\n

Art. 16 Termination of contract and express termination clause<\/strong><\/p>\n

16a. Eredi dei Papi Srl may terminate the contract entered into by simply notifying the user and stating the reason; in that case the user will be entitled exclusively to the refund of any sum already paid.<\/p>\n

16b. The obligations assumed by the user under these contractual terms, as well as the guarantee of successful payment, are essential in nature, so that by express agreement, the user’s failure to fulfil even one of the aforementioned obligations will result in the termination of the contract by operation of law pursuant to article 1456 of the Italian Civil Code, without the need for a court ruling, without prejudice to the right of Eredi dei Papi Srl to take legal action for compensation for further damage.<\/p>\n

Art. 17 Privacy, cookies and terms of use of www.eredideipapi.com<\/strong><\/p>\n

17a. For the Privacy Policy, Cookie Policy and terms of use of www.eredideipapi.com, please refer to the relevant dedicated sections.<\/p>\n

Art. 18 Resale of the Service<\/strong><\/p>\n

18a. Users are not authorised to reproduce, duplicate, copy, sell, resell or exploit any portion of www.eredideipapi.com and its services without the express permission of Eredi dei Papi Srl.<\/p>\n

Art. 19 Copyright<\/strong><\/p>\n

The Eredi dei Papi trademark and www.eredideipapi.com are the property of Eredi dei Papi Srl. Therefore, photographs, texts, descriptions, considerations and everything included in the site are the property of the company Eredi dei Papi Srl.<\/p>\n

Consequently, the reproduction, in whole or in part, of any part of the site, including photographs and texts, is prohibited without the prior written authorisation of Eredi dei Papi Srl.<\/p>\n

Art. 19 Applicable Law<\/strong><\/p>\n

19a. These general terms and conditions of sale are governed by Legislative Decree 206\/2005 (Consumer Code), Legislative Decree 70\/2003 \u2013 implementing European Directive 2001\/31\/EC \u2013 on Electronic Commerce, EU Regulation 679\/2016 on the Protection of Personal Data, Legislative Decree 21\/2014 \u2013 implementing European Directive 2011\/83\/EU on Cookie Policy \u2013 together with the rules of the Italian Civil Code on contracts and any other applicable regulation or Law.<\/p>\n

Art. 20 Jurisdiction and Competent Court<\/strong><\/p>\n

20a. Any dispute relating to the application, performance, interpretation and breach of purchase contracts entered into online through the e-commerce site www.eredideipapi.com is subject to Italian jurisdiction; for anything not provided for, these general terms refer to the provisions of Legislative Decree 206\/2005.<\/p>\n

20b. For any dispute between the parties concerning this contract, the competent court will be the court of the district in which the consumer is domiciled, pursuant to Legislative Decree 206\/2005.<\/p>\n
